Terms and Conditions

1. PURPOSE

By virtue of this contract, “Monasterio San Pedro Cusco” (hereinafter, the “HOTEL”) will provide accommodation to the GUEST in the room and its accessories, in exchange for a price, for the number of days indicated in the Hotel Registration Card. In no case shall the stay exceed 30 consecutive days.

1.1. The room will be the one indicated in the Hotel Registration Card. The HOTEL may change the room if the guest accepts the change and it is for a room of equal or better conditions, or in case of force majeure.

1.2. The check-in time is from 3:00 pm on the day of arrival, and the check-out time is until 1:00 pm on the day of departure. The period between check-in and check-out constitutes the hotel day. Early check-in or late check-out is subject to availability, and the GUEST must pay the corresponding fee.

1.3. Accommodation is provided regardless of the time the GUEST actually spends in the room. Partial use incurs the full daily rate.

1.4. The provision of the services under this contract, and any complementary services offered by the hotel, is subject to availability and the schedules, shifts, or physical availability of goods, facilities, or spaces.

The room rate is as indicated on the Hotel Registration Card and corresponds to the reservation.

2. PRICE

2.1. The price for this contract corresponds to the nightly rate that the GUEST agrees to pay as indicated in the Hotel Registration Card, which will be reflected in the corresponding invoice. If the reservation was made and paid through a travel agency, the rate will be the one agreed directly with the agency.

2.2. The GUEST must also pay for all charges related to food, beverages, laundry, and any other expenses incurred during their stay that they choose to charge to their account.

2.3. The GUEST declares that they have been informed of the room rates and overall nightly rates.

2.4. Failure to pay will result in late fees at the maximum rate permitted by law.

3. CUSTODY OF MONEY AND VALUABLES

In accordance with Article 1195 of the Commercial Code, GUESTS may deposit money and valuables with the HOTEL for safekeeping under receipt. This must be done through the designated HOTEL employee, and a formal record must be made listing the money or valuables delivered. The HOTEL’s responsibility will be that of a depositary, under the terms of Article 1196 of the Commercial Code. Valuables such as jewelry, cameras, money, computers, cell phones, and equipment left in the room or other areas outside the designated deposit locations are at the sole risk of the GUEST. In this case, the HOTEL assumes no liability in case of loss or damage.

4. OBLIGATIONS

4.1. HOTEL OBLIGATIONS:

  • To provide the accommodation services outlined in the contract.
  • To address, process, and respond to any suggestions, complaints, or claims made by the guest.
  • To safeguard the money and valuables that the guest has delivered for safekeeping.
  • To comply with all other obligations set forth by law.

4.2. GUEST OBLIGATIONS:

  • To provide a valid ID for registration (DNI for Peruvian nationals, passport or applicable document for foreign nationals). Minors must provide valid identification.
  • To pay for the accommodation and corresponding taxes.
  • To pay for all charges made to their account during the stay.
  • To maintain decorum and appropriate attire.
  • To be liable for any damages caused by the GUEST or their companions.
  • To register any companions or guests visiting the room at the hotel reception and pay the applicable fee for each.
  • To respect the maximum occupancy limit for the room.
  • To engage in any risky activities (e.g., sports, physical exercises, or using equipment) at their own discretion and responsibility, exonerating the HOTEL from any liability in case of injury.
  • To use the furniture, equipment, and facilities responsibly and pay for any damages caused to the HOTEL’s property.
  • To respect the authority of the HOTEL Manager.
  • To allow hotel staff reasonable access to the room for inspection or cleaning.

5. TERMINATION OF THE CONTRACT

The accommodation contract may be terminated in the following circumstances:

  • Upon expiration of the agreed term.
  • Due to failure to pay the agreed amount or any other charges.
  • If, in the HOTEL’s judgment, the guest’s behavior or attire disturbs the peace or health of other guests or visitors.

6. EFFECTS OF TERMINATION

  • Upon termination, the HOTEL may freely dispose of the room.
  • The HOTEL may enter the room, inventory the GUEST’s belongings, and store them safely at the GUEST’s risk and expense.

7. MISCELLANEOUS

7.1. Legal Nature: This contract is a lease agreement, commercial in nature, and an adhesion contract.

7.2. Proof of the Contract: The hotel registration card, signed by the GUEST, constitutes proof of the contract. The GUEST agrees that the amount stated in the invoice is enforceable.

7.3. Prohibition of Sexual Exploitation: The HOTEL rejects any form of sexual exploitation or abuse, including sexual tourism and exploitation of minors.

7.4. Smoking Penalties: All rooms and public areas of the hotel are smoke-free. Smoking will result in a penalty of USD 100 per day, plus two additional nights’ room charges for cleaning and deodorizing the room.

7.5. Environmental Conservation: The HOTEL promotes the conservation of flora, fauna, and cultural heritage.

7.6. Anti-Discrimination Policy: The HOTEL rejects any form of discrimination based on gender, race, color, national origin, religion, political opinion, or any other condition.

8. DATA COLLECTION AND USAGE POLICY

By using this website, you agree to Meta’s Business Tools policies regarding the collection of personal data for analytical and advertising purposes. The HOTEL may collect and share data such as your contact information and activity on the website with Meta for purposes such as personalized advertising, audience targeting, and performance measurement. All data will be encrypted for security, and Meta will not share your information with third parties without your consent unless required by law.

9. ACCEPTANCE OF TERMS

By accessing and continuing to browse this website, as well as by making a reservation, you agree to these terms and conditions, including the data collection policies outlined above. Your reservation or use of the services provided by the HOTEL constitutes acceptance of all the terms and conditions stipulated in this document.

10. GOOGLE TAG MANAGER POLICY

If third-party tags are used, the GUEST acknowledges that:

  • Google is not responsible for third-party tags.
  • Google may review these tags for compliance.
  • The GUEST or entity representing them ensures they have the necessary rights to upload the tags.
  • It is prohibited to upload personally identifiable information or engage in any illegal activity through the service.

Data collected through the use of Google Tag Manager may be used to enhance the service but will not be shared with other Google products without user consent.
